Statutory Nuisance

In general terms a statutory nuisance is a problem which interferes substantially and unreasonably with your wellbeing, comfort and enjoyment of your property.  When considering whether a statutory nuisance exists, we will take account of all the circumstances, for example when and how often the problem is caused, how many people it affects and its severity.

 

We will normally ask for some written evidence in the form of a diary record.  We will assess this as it wil help us decide whether the problem may be a statutory nuisance.  We may also need to witness the problem for ourselves to decide if it is a statutory nuisance.

 

When we are satisfied that a statutory nuisance exists, we will take steps to have it abated.  This may include serving an abatement notice on the person responsible for causing the nuisance.  The notice will require the person to take steps to stop the nuisance continuing.

 

Failure to comply with an abatement notice is an offence and may lead to prosecution and a fine.
