Planning Appeals

Summary

Information on appealing against a planning decision and links to the appeal administrative body, the Planning Inspectorate.


 

Appeals in England are made to the First Secretary of State and are administered by the Planning Inspectorate.

 

Only the person who made the application for planning permission (or their agent) can appeal.

 

Process and deadlines

Appeals are considered by a Planning Inspector, appointed by the First Secretary of State in England. Most are handled through written representation, though some can be decided by a hearing. A few are decided after a public inquiry.

 

  • The deadline for submitting an appeal is now 6 months from the date the decision was issued (or in the case of non-determination, 6 months from the date the decision should have been made).
  • In the case of advertisement appeals, the appeal must be made within 8 weeks of the date the decision was issued.
  • For appeals relating to works to trees, the appeal must be made within 28 days of the date the decision wasnullh issued.

 

How to submit a planning appeal online

Please remember that there are strict time limits on the right to appeal. Appeals submitted outside these limits will normally be turned away.
