REPORT OF THE DEVELOPMENT CONTROL MANAGER
(i) 12/00032/VAC Section 73 application to vary condition 4 of planning application 11/00118/FUL relating to glazing – 21 Meadowcourt Road, Oadby
Two speakers had been granted dispensation to speak and addressed the committee for the permitted time.
A Mr Wolsey appeared on behalf of the applicant and referred to the Council’s 45 degree rule which he said did not apply here and that the measures taken should alleviate any concerns regarding over looking the neighbouring property. He urged Members to have good planning reasons if they were minded to refuse the application as such an outcome would be appealed against.
Councillor Mrs Dickinson appeared on behalf of the objectors who considered that the screen was an eyesore in itself and only covers part of the garden. In any case, it could be removed. The high hedge around No. 23 was deciduous and did not offer screening all year round. In her view, the neighbouring property was compromised by this application and it should be refused.
Ms Jinks then proceeded to introduce her report, referring to the Agenda update which was then distributed to those present and time permitted by the Chair for the contents to be read.
The proposal is for the removal of condition 4 of planning application 11/00118/FUL relating to obscure glazed windows on the garden room. At the August 2011 meeting, Members resolved to add a condition to planning application 11/00232/VAC requiring approval of the type and density of the obscure glazing but unfortunately, due to an administrative error, this condition was omitted. Despite corrective action, the end result means that the original condition effectively remains and despite efforts to negotiate with all parties, those discussions have resulted in this further application.
The main issue with this application is whether the obscure glazing is still required and it possible effect upon neighbouring properties. Since August 2011, the framework for the screen has been erected and should reduce any overlooking potential but in view of the content of the agenda update, Condition 1 of the recommended permission can be amended accordingly.
During discussion, it became clear that Members who had attended the site visit agreed that the potential for overlooking no longer existed, that the costs of an appeal were not a material consideration and that there were no reasonable grounds for refusal. Upon being put to a vote, a motion from the Chair to accept the Officer Recommendation was carried by eleven votes for to four votes against.
RESOLVED: That for the reasons set out in the attached report, the recommendation to permit be approved, subject to the conditions contained within the report, of which condition one will be varied accordingly.
