23 July 2019, a man aged 40 who is a Council tenant in Oadby, was interviewed under caution in relation to possible offences under the Environmental Protection Act 1990 in transporting and storing asbestos waste at his rented home.
Safe removal of the asbestos has been completed by the Council and it is considering a range of possible offences by the self-employed man.
The action today was the culmination of an investigation by a Council Officer and police after reports of asbestos waste in the front garden were received. Subsequent testing of material on site showed asbestos fibres of a number of types that were subsequently safely removed. The Council has powers to charge the person or persons responsible not only for the cost of the clean-up and removal but the investigation itself.
The removal, transport and storage of hazardous waste are subject to licencing by the Council and the Environment Agency. Offenders found guilty of a criminal offence can face unlimited fines and possible prison sentence.
